AGREEMENT (this “Agreement”) BETWEEN CUSTOMER AND FROSCH
INTERNATIONAL TRAVEL, INC.
This Web site (www.thetravelrewardcard.com or this “Site”) and any
validly issued Travel Reward Card (the “TRC”) have been
offered to you, the customer (the terms “you” or
“customer” in this Agreement refer to the individual or
individuals using this Site and/or redeeming validly issued TRCs) by
Frosch Rewards and Incentives, a division of Frosch International
Travel, Inc. (“Frosch”), conditioned on your acceptance
without modification of this Agreement and its terms, conditions and
notices contained herein. Your use of this Site and/or the
redemption of a TRC constitutes your agreement to all such terms,
conditions and notices contained in this Agreement and the practices
stated in this Site’s Privacy Policy
incorporated herein by reference.
TERMS AND CONDITIONS OF THIS SITE AND THE TRAVEL REWARD CARD
The terms and conditions of The Travel Reward Card redemption program are established and administered by FROSCH, not by the participating hotels, including but not limited to the Marriott hotel brands. The participating hotels and hotel brands are not affiliated with The Travel Reward Card or FROSCH and do not endorse this program.
Card Use
The TRC may only be redeemed by you for travel package(s) (“Package(s)”)
set forth on this Site and only for such Packages that are affiliated
with the TRC redeemed by you. The TRC has been prepaid and is the
property of and issued by Frosch. Once the TRC has been registered
on this Site, the TRC shall become inactive and you shall have to use
your username and password as created by you during the registration
and redemption of your TRC.
Tax Liability
Federal and state income tax liability, and any other federal state, or local
taxes applicable to you from the receipt of a TRC are your sole
responsibility. The use of the TRC is void where prohibited by
law. The TRC or any travel related activity procured as a
result of the redemption of a TRC cannot be converted to cash.
Loss, Theft or Fraud
Frosch shall not be responsible for the loss of, theft of, or damage to any
TRC and shall not be responsible for the loss of any travel or TRC as
a result of identity theft or fraud.
Valid
The TRC is valid for twelve (12) months and two (2) weeks (the
“Expiration Date”) from the date Frosch or any of its
affiliates issues a TRC. The TRC is subject to this Agreement which
is referenced on the TRC and which by accepting the terms and
conditions of this Agreement, you acknowledge you have read and fully
understand. Any TRC must be redeemed and travel completed by the
Expiration Date.
Limitations
The TRC may not be resold, bartered or otherwise transferred to anyone
else at any time. You warrant that by accepting the TRC, you will
not resell, barter or otherwise transfer the TRC, including
reselling, bartering or transferring it on the Internet. Any breach
by you of this provision of this Agreement shall constitute a
material breach of this Agreement and may result in the immediate
termination of the use of the TRC for any purpose or benefit that may
accompany the TRC. The minimum time required by Frosch to process a
travel package as a result of your redemption of a TRC is at least
thirty (30) business days prior to your departure. Packages may not
be broken up at any time.
Combination
The TRC may not be combined with or applied to other certificates, gift
cards, other travel reward cards, promotions or special offers,
including, but not limited to: upgrades, government fares,
tour-travel packages, group fares, convention/company meeting fares,
bereavement, companion fares, senior citizen discounts, corporate
agreements, student fares, child fares, travel industry discounts,
Internet fares, frequent flyer programs or any unpublished programs.
Frequent flyer miles and/or airline coupons CANNOT be used in
conjunction with your TRC for any purpose, including but not limited
to upgrades.
Restrictions
All TRC redemption reservation requests must first be made through this
Site and second, with the assistance of an Agent (as defined
hereinafter under the Section entitled “Use of Frosch Travel
Agent”). The TRC recipient is responsible for all
reservations in accordance with this Agreement. You may not
change the format or included feature components of the TRC at
any time. The TRC is not redeemable for cash, credit, or
reimbursement. Frosch is not responsible if the TRC
and/or travel documents are lost, stolen, or expired, and the TRC
and/or travel documents are void if altered in any way. No photocopy
or reproduction of the TRC may be used in place of any TRC at any
time. The TRC is void if sold for cash or other consideration. The
TRC is only valid for recipients of a TRC residing and flying (if the
Package includes air) from the continental United States. It will be
at the sole discretion of Frosch to expand the use of the TRC to
other countries and/or US states and/or territories. If you have to
amend your travel experience once it has entered the Travel Confirmed
Stage, the minimum charge is fifty dollars ($50) per person plus any
charges in line with the individual hotel, airline, and/or other
travel supplier’s specific policy; however, notwithstanding the
foregoing, changes to names of the individuals traveling through use
of the TRC are never allowed. You will be advised of the exact cost
at the time of the revision. Space is subject to availability.
Please note that, depending on when you make the change/cancellation
and depending on the specific travel supplier used for the various
components of your Package, there may be components of your Package
that are completely NON-REFUNDABLE. Other restrictions may apply.
Notwithstanding the foregoing, changes and/or additions may be purchased at an additional cost to you through an Agent (as defined hereinafter under the Section entitled “Use of Frosch Travel Agent”). If you fail to show up on your reserved date of travel without notification, it may result in the full forfeiture of your Package, without the possibility of a refund or replacement Package, and the credit card you used to obtain your reservation will be charged in accordance with each vendor’s individual cancellation policy.
Transportation
If a Package includes air transportation, travel will be serviced by
American Airlines or as otherwise stated in the Package. All
transportation is subject to availability and other conditions,
including but not limited to, the availability of certain classes of
service. The classes of service that determine whether space is
available for travel using the TRC is determined by each
participating transportation vendor and is at the sole discretion of
Frosch. All transportation tickets issued in conjunction with a
Package will be subject to the individual carrier’s Conditions
of Carriage and any other rules or regulations of the transportation
vendor and/or federal, state or local government agencies. Frosch
reserves the right, in its sole discretion, to (i) change
transportation vendors included in a Package up to the time travel
for the Package is booked and ticketed; (ii) use charter airlines for
any Package; and (iii) substitute ground transportation for air
transportation if you reside within 150 mile radius of the
destination set forth in the Package. No open tickets, open returns,
open jaws, stopovers and circle trips are permitted through use of
the TRC.
Lodging
Hotel nights must be used consecutively. Hotel rooms are assigned by the
hotel at the time of check-in. Requests for specific room types or
locations can be requested through an Agent (as defined hereinafter
under the Section entitled “Use of Frosch Travel Agent”)
at the time of reservation, but are not guaranteed. You will be
responsible for charges incurred of a personal nature at a hotel,
including but not limited to: phone calls, tips, laundry, beverages,
meals, taxi and bus fares, passport and visa fees, etc., unless
otherwise stated. You must guarantee hotel reservations with a valid
credit card, and you may need to present a hotel travel
certificate/voucher at the time of reservation. You must present and
surrender the hotel travel certificate/voucher issued to you at the
time of your check-in to your reserved hotel. The number of
occupants and ages of children allowed per room varies by property
according to local fire code and individual hotel policy.
Other Lodging and Transportation Restrictions
Hotels and car rental companies require a valid credit card at the time of
check-in/pick-up. The amount of the deposit (“Deposit(s)”)
varies depending on the hotel/car rental company, and such Deposit
may be as much as $500 or more. Some hotels and car rental companies
may put holds on your credit card for the amount of your total
expected bill. For car rentals at check-in/pick-up, the driver will
need to present his/her own validly issued state driver's license and
credit card, which should both match the driver's name. You will need
to have an amount equal or greater to the required Deposit(s) in
available funds on your credit card to use as a Deposit at
check-in/pick-up. If you will be presenting a valid check debit card
rather than a valid credit card at the time you retrieve your rental
car, the car rental company will place a hold on your card for the
deposit amount, and these funds will not be available until the car
is returned. Note that many car rental companies will not accept a
debit card as a deposit when the vehicle is picked up, and rental
will be denied. International car rental companies accept credit
cards only and require the traveler to have as much as $1,000 in
available funds on the credit card used by you for the Deposit(s).
Information Provided by You
You warrant that all information supplied by you in using this Site and
the TRC, including information supplied by you regarding other

Site, the TRC and/or other services provided by Frosch in accordance

the TRC to obtain the necessary documents for travel, including
passports and visas. In addition, it is the sole responsibility of
passengers traveling through the use of the TRC to make sure the
spelling of their names on any tickets matches the spelling of their
name on their passports.
Travel Destinations
Although most travel is completed without
incident, travel to certain destinations may involve greater risk
than others. Frosch urges passengers to review travel prohibitions,
warnings, announcements and advisories issued by the United States
Government prior to booking travel to international destinations.

Travel Reward Cards are valid one (1) year and two (2) weeks from the date of issue. The extra two weeks ensures that by the time you receive your card, you will have one (1) full year to redeem your card and complete your travel.
Upon receipt of your card, you may also find the expiration date on the card itself and on the gift-box it's packaged in. On the card, you will find the expiration date printed on the bottom, right-hand corner of each card. On the gift-box, you will find it printed in the center on the back of each box.
We need a lead time of at least 30 days prior to departure to process your travel request. Our collection of travel experiences include domestic and international destinations around the world and may include hotel accommodations, round-trip air transportation, car rentals, event tickets, cruises, major sporting and entertainment experiences, prepaid Visa® cards, tours, transfers, and more. We want to ensure there is enough time to coordinate, book and confirm all segments of your trip and ensure you receive your travel documents prior to your departure date. In some cases, we may be able to accommodate late bookings for an additional fee.
Travel is always subject to availability, therefore in order to avoid disappointment we highly recommend that you make your travel selection as soon as possible.
In some cases, we may be able to accommodate late bookings for an additional fee. If you book within 30 days of departure, a nonrefundable Express Service "rush fee" of $50.00 will be assessed plus any additional rush processing charges that might stem from booking late such as fees imposed on us by our suppliers, rate increases, etc. All applicable Express Service fees and charges are provided for the selected itinerary before booking. Please note that the absolute minimum required lead time is seven business days prior to departure.
Travel Reward Cards are good for one (1) year and two (2) weeks from the date of issue. The reservation request system will not allow you to use a reward card for a travel date later than the expiration date of the reward card.
When you go to www.thetravelrewardcard.com, there is now an option to request an extension online. At the bottom of the page you will see the following link "Extend Reward Cards". For a $200.00 fee, a Travel Reward Card near expiration, or within thirty (30) days of expiration, may be extended for another twelve (12) months from the date of the original expiration date. Extension requests made more than thirty (30) days past the expiration date will be denied. Travel Reward Cards may only be extended one (1) time.
PLEASE NOTE: we will only consider extending Travel Reward Cards that are near expiration or have been expired less than thirty (30) days from the date you submit your request. Travel Reward Card holders must make their request online at The Travel Reward Card reservation request website. Simply click on the "Extend Reward Cards" link located at the bottom of the page, fill in the requested information and email it to us at extendreq@thetravelrewardcard.com along with your payment information before your card expires, or within thirty (30) days of the expiration date.
All extended Travel Reward Cards will be subject to the reward card Terms & Conditions, and will be valid for twelve (12) months from the date of the original expiration date. Only requests from the original Travel Reward Card recipient will be considered. Credit cards (Visa, MasterCard, and Discover) are the only form of payment that will be accepted for reissues. Cash, checks, money orders, will not be accepted.
It will take up to 14 days from the date we receive your request for a Travel Reward Card representative to process the extension, which will be valid for twelve (12) months from the date of the original expiration date and will be shown in your Travel Reward Card account with the new expiration date. Please note that extension requests will only be accepted from the original Travel Reward Card recipient who originally qualified for the award. Extension requests from anyone other than the original card holder will be denied.
THE TRAVEL REWARD CARD CANNOT BE EXTENDED ONCE IT'S BEEN EXPIRED OVER THIRTY (30) DAYS. All Travel Reward Cards must be redeemed and travel must be completed by the expiration date. Travel Reward Cards are valid one (1) year and two (2) weeks from the date of issue. Expiration dates are printed on the front of each card. The extra two weeks is meant to ensure that by the time you received your card, you had one (1) full year to redeem your card and complete your travel.
No, hotel nights must be used consecutively. In addition, we cannot break up any part of your travel experience.
While we do not impose any blackout dates or prohibit travel during certain periods of time, there are most certainly days when seats, rooms and cabins are not available. If you choose to redeem your Travel Reward Card for a very desirable destination, during a peak travel period - and have waited until the last minute to book your trip - it's likely your first choice will be sold out. While there are no blackout dates, around Christmas, New Year's, Spring Break and special event dates such as Mardi Gras in New Orleans most hotels sell out more than a year in advance.
Travel is always subject to availability, therefore in order to avoid disappointment we highly recommend that you make your travel selection as soon as possible.
Absolutely! Once you register your Travel Reward Card, select your travel experience, and submit your travel request, we will check availability for the two (2) dates you request. If space is available, yet you instruct The Travel Reward Card to check another set of dates, a service fee of $25 per date checked will be incurred.
Availability will vary according to departure and arrival cities, travel dates, and choice of hotels or cruises. Travel is subject to availability in our booking inventory. We do not control availability (airlines, hotels and other travel suppliers' reservation systems do). Availability may change dynamically and at times significantly numerous times during any given day.
You must have The Travel Reward Card in-hand and the card must be registered in order for us to check availability.
Two people occupying one room for their entire stay.
Most hotels allow children up to the age of 16 to stay in the same room at no charge. They may charge a small fee for a rollaway bed in the room if you need one. You will be responsible for this additional charge. Number of occupants and ages of children allowed per room varies by property according to local fire code and hotel policy. A member of our Professional Travel Consultants will be happy to provide you with this information upon request.
The Travel Reward Card should be treated just like cash. If the card is lost, stolen or destroyed we are unable to cancel or replace it. If you lose or you suspect someone has stolen your card please notify us as soon as possible.
Hotels will require a credit card to guarantee your reservation upon booking. If you no show or do not cancel your reservation according to the individual suppliers deadline it will result in your credit card being charged and the full forfeiture of your travel reward. For cruises, airline tickets and sporting events the result is the full forfeiture of your travel reward. No further compensation may be considered.
Sometimes a hotel, cruise, airline or other travel supplier is already booked for your preferred requested dates of travel. If they are full we will try our best to find a comparable hotel or cruise or you may change your preferred travel dates. While there are no blackout dates, around Christmas, New Year's, Spring Break and special event dates, e.g. Mardi Gras in New Orleans, most hotels sell out at least a year in advance.

Once your reservation request has entered the "Travel Confirmed" stage, you have approved the travel experience and we have booked, confirmed and paid for your trip. Revisions, cancellations, and refund policies vary by supplier. Supplier cancellation fees can be up to 100% of the trip cost. No-shows are non-refundable. Refund restrictions and policies for unused travel or vacation components vary and are subject to applicable rules of each supplier. Insurance premiums, airfare and some supplier fees are non-refundable. Please inquire about supplier refund policies at the time of booking, prior to applying any payments to a booking.
The Travel Reward Card may impose a cancellation penalty in addition to any supplier penalties. Our penalty ranges from $50 per person minimum, up to 10% of the total travel package. A member of our Professional Travel Consultants will be happy to provide you with this information upon request. Travel insurance is strongly recommended. It may be purchased, which may cover cancellation for covered reasons as outlined in the insurance policy. Insurance policies vary with differing exclusions (such as pre-existing conditions, work related issues, change of mind, etc.).
If you have to amend your travel experience once it has entered the "Travel Confirmed" stage, the minimum charge is $50 per person plus any charges in line with the hotel, airline and/or other travel suppliers specific change fee terms and conditions. For example: if your reward includes domestic non-refundable air transportation, the non-refundable ticket change fee averages $200 per ticket (up to $450+ on some international fares) PLUS any applicable difference in fare. If you need to make "same day" changes, there is an additional fee that averages around $75 per ticket. You will be advised of the exact cost at the time of the revision. Space is subject to availability. Please note that depending on when you make the changes/cancellations and what travel suppliers we are using for specific components of your travel package there might be components of your travel experience that may be completely NON-REFUNDABLE. Changes to names are never allowed. Please ensure that you are 100% set on your plans prior to submitting your "Travel Approval Form". We realize that situations do come up unexpectedly that necessitate the cancellation of a trip. We offer trip cancellation insurance, which covers most eventualities. Please review the details of our insurance. We strongly recommend that you purchase insurance with your package. You cannot add insurance after a reservation is confirmed.

An open jaw is a return from a different city than the one in which you arrived. For example, flying from London to Washington but returning Los Angeles to London.

Passenger identification must exactly match the name on the reservations or ticket(s). The Travel Reward Card travel packages are subject to change without notice. Participating properties and services are subject to change. A particular hotel, tour or cruise may have been pulled from the program for various reasons. We may have received repeated complaints from Travel Reward Card travelers. Or, a particular property may have changed ownership. Perhaps a component of the travel reward is just not offered anymore. We consistently update the travel packages, therefore before planning a stay, be sure to check the current components, services and participating properties by talking to one of our Professional Travel Consultants members or checking the experiences on this website on a regular basis.
Hotel and resorts may impose a length of stay requirement on certain days or times of the year or on certain weekends. This means that if your package is for two-nights and the hotel happens to have a 'length of stay requirement' of four-nights during the time you would like to stay, you either need to change your preferred dates of travel or pay for the additional nights in order to meet the minimum stay requirement. Length of stay requirements are subject to anyone who stays at the hotel during this time and has nothing to do with a restriction imposed on you by The Travel Reward Card.
No, unless otherwise stated, it does not include buffets or alcohol.
The terms and conditions of this reward redemption program are established and administered by The Travel Reward Card and FROSCH, not by the participating hotels or hotel brands. The participating hotels and hotel brands are not affiliated with The Travel Reward Card and FROSCH and do not endorse this program.
Some of the New York properties in The Travel Reward Card program are running at a 98 percent occupancy rate. Availability in NY is hard to find regardless if you were a business traveler or using The Travel Reward Card. This has nothing to do with a restriction imposed on you by The Travel Reward Card.
Some resorts levy an extra (and frequently unexpected) fee for amenities such as coffee, shuttles or golf, whether guests use them or not. Resort fees are left up to the discretion of the hotel and are subject to change. If The Travel Reward Card package does not specifically state that resort fees are included then depending on the resort, a fee paid directly to the hotel may be required. Taxes are not the same as resort fees.
In most cases, yes. Event Tickets can be upgraded subject to availability and can be paid for using your personal credit card.

Please be sure to secure your tickets in a safe place as they are non-replaceable in the event of theft or loss.
Should for any reason a day's play or event be partly or wholly cancelled for any reason including without limitation, inclement weather, no refunds or credits will be given. Travel insurance was offered at the time of reservation that may offer coverage for these circumstances. Should a facility for any reason be destroyed or made unusable no refund or credit will be given.
Once the sporting event package has been booked and confirmed there are no refunds, cancelations or exchanges. Changes to the sporting event package will only be considered based on availability.
